Terms & Conditions
1. Tour Reservation
1.Upon receipt of full payment, Roam Sailing will reserve your place on the selected tour. The booking shall be considered official and binding only upon confirmation and acceptance by Roam Sailing, with a corresponding confirmation sent to you.
2. Booking your Tour
1. To secure your place on a Roam Sailing tour, a non-refundable deposit of €250 euros per person is required, unless otherwise agreed upon in writing by Roam Sailing.
2. The successful payment of your non-refundable deposit or full payment signifies your acknowledgement and acceptance of Roam Sailing's Terms and Conditions.
3. Your reservation will only be confirmed upon receipt of the full payment by Roam Sailing. A non-refundable deposit of €250 euros per person is required to secure your booking.
4. Upon receiving confirmation of your booking enquiry from Roam Sailing, you will have a period of 7 days to secure your reservation by making a non-refundable deposit of €250 Euros.
5. Please find below a detailed breakdown of deposit payment and booking payments with associated timeframes:

For bookings made within 90 days before departure:

The final payment will be due 7 days after the deposit has been received.
For bookings made within 60 days before departure:

The final payment will be due 3 days after the deposit has been received.

Failure to meet any payment deadlines may result in the forfeiture of your booking without further notice.
6. All bookings will be confirmed through email. It is your responsibility to ensure that you receive all emails from Roam Sailing, as we are not liable for any emails filtered into junk mail folders.
7. For all bookings made using a coupon or discount code, payment is required at the time of booking, unless otherwise explicitly agreed upon in writing by Roam Sailing.
8. If you have any physical, medical, or special needs, it is mandatory to inform Roam Sailing at the time of booking.
9. The person making the booking on behalf of other travellers holds the authority to bind all travellers Roam Sailing’s terms and conditions.
10. Bookings made before April 3rd, 2020, are granted an extension to pay the remaining balance.
11. Any invoices sent before May 21st, 2020, are considered null and void. This information was communicated via email to those who made a non-refundable deposit (Applies to pre-Covid-19 bookings only).
12. All bookings utilizing travel credits must be made by 1st April 2024 for tours scheduled in either 2023 or 2024. If no communication has been made by email to us, Roam Sailing will assume you have forfeiting all travel credit.
13. The confirmation of your tour, when using a travel credit, is contingent upon availability. Confirmation of our availability will be communicated to you in writing by Roam Sailing.
14. Please note that discount codes cannot be applied retroactively to bookings using a travel credit unless a code was utilised during the original booking.
15. Failure to pay the deposit within the specified timeframe may result in cancellation without prior notice.
16. All deposits are non-refundable.
17. All reservations are subject to availability, and confirmation of a place on a Roam Sailing tour is only granted once Roam Sailing receives full payment.
18. Split payment option - Will allow you to divide your total payment into three equal payments, minus deposit. A one-time setup fee of €15 Euros will be applied to the initial invoice. The final payment instalment should be completed by the specified due date indicated on your final invoice.

3. Tour Details and Conditions
1. It is essential to carefully review the tour details provided, including the list of inclusions. No refunds or allowances will be made for any items or services not explicitly mentioned in the inclusions.
2. If an individual on a Roam Sailing tour poses a direct threat to themselves or others, we reserve the right to terminate their participation in the trip or activity.
3. Roam Sailing does not provide personal devices (such as wheelchairs, hearing aids, or prescription eyeglasses) or services of a personal nature (such as pushing a wheelchair or assisting with eating, toileting, or dressing). Guests requiring such assistance must be accompanied by a companion.
4. Please note that Roam Sailing does not employ medical staff. If you require medical attention during your tour, you are responsible for any associated costs and any potential loss of tour days.
5. The vessel advertised for the tour may be subject to change or alteration due to unforeseen circumstances at any time, as determined by Roam Sailing.
6. Roam Sailing or the Captain reserves the right to modify the itinerary due to unforeseen circumstances and cannot be held liable for any resulting losses.
7. In the event of any unsuccessful legal action against Roam Sailing PTY LTD, you agree to bear all costs incurred, including but not limited to attorney/client costs.
8. While we strive to ensure the accuracy of our website, Roam Sailing cannot be held responsible for typographical errors or errors arising from unforeseen circumstances.
9. These terms and conditions apply to all bookings made online, over the phone, through social media, or directly through our website.
10. By making a booking, you confirm that you have read, understood, and agree to abide by these terms and conditions. The terms "us," "we," and/or "our" in these terms and conditions refer to Roam Sailing PTY LTD.

4. Cancellation Policy
1. In the event that you cancel your booking, additional costs will be incurred to cover expenses already incurred by Roam Sailing.
2. If you cancel your booking outside of the 100-day notice period, no refund of the deposit will be provided, and it cannot be used as a credit towards another booking.
3. Cancellation fees are calculated as a percentage of the tour price according to the following schedule:
- More than 100 days' notice: Only the deposit is forfeited.
- 99 - 90 days' notice: 25% of the tour price is forfeited.
- 89 - 60 days' notice: 50% of the tour price is forfeited.
- 59 - 30 days' notice: 75% of the tour price is forfeited.
- 29 or fewer days' notice: 100% of the tour price is forfeited.
4. Refunds will be issued using the same payment method used for the initial transaction with Roam Sailing.
5. Roam Sailing processes all refund payments through its online payment system. Please note that any fees or additional charges imposed by your bank to accept the refund are beyond the control of Roam Sailing and will not be the responsibility of Roam Sailing.
6. Refund amounts may vary daily due to fluctuations in currency conversion rates by your bank.
7. Refunds can take up to 30 working days for processing.
8. All cancellations must be submitted in writing via email to Roam Sailing.
9. Payments made through our online system will be subject to a 3.95% payment fee, which is charged by the Pin Payments system and not by Roam Sailing Pty Ltd.

5. Amendment of Booking
1. If, after your booking has been confirmed and it is outside of 60 days before the scheduled departure, you may request to change your booking to another available departure date, subject to availability.
2. An amendment fee of €50 EUR will be applied to cover the administrative costs associated with changes or amendments made to any reconfirming bookings. This fee includes changes to names and departure dates.
3. If you wish to change your already confirmed reservation to a different departure date and the new date has a higher value, the price difference must be paid at the same time as the final invoice. If the original final invoice has already been paid, you will have a grace period of 5 days to settle the remaining amount.
4. If you are unable to travel due to contracting the COVID-19 virus or being diagnosed with COVID-19 within 7 days of the scheduled departure date, you also have the option to transfer your booking to another available tour within the 2023 season, subject to availability. No trip transfer fee will be charged. Please note that if you choose a higher fare departure, you may be required to pay the fare difference. To make changes to your booking, including transferring to another tour or selecting a new departure date within the 2023 season, please contact Roam Sailing directly.
5. In continuation from the COVID-19 clause, Roam Sailing will request a valid medical certificate in English as evidence of a positive COVID-19 diagnosis.

6. If we cancel your booking
1. Roam Sailing reserves the right at any time to cancel or change your booking due to operational requirements, unforeseen circumstances, or events beyond it’s control.
2. In the event that Roam Sailing needs to cancel or change a tour/booking, we will provide you with reasonable notice, taking into account the circumstances. If available, we will offer a comparable alternative.
3. If the change or cancellation is caused by circumstances beyond Roam Sailing's control, such as political unrest, airport or port closures, industrial disputes, war or threat of war, riots, civil strife, terrorist activity, natural and nuclear disasters, fire, epidemic or health risk, pandemic, adverse weather conditions, Acts of God, or similar events, a travel credit will be issued for future use on Roam Sailing tours. Please note that any losses incurred in such situations are the responsibility of your travel insurance.
4. If we are unable to find a suitable alternative or if you choose not to accept the offered alternative, we will provide a credit that can be held for 12 months from the date of the original tour.
5. Roam Sailing reserves the right to cancel or change the name of a ship for any tour departure that has not reached its minimum number of passengers (e.g., Croatia Sail with less than 15 passengers). Roam Sailing cannot be held responsible for any costs or travel arrangements affected by tour cancellations or rescheduling.
6. If you are entitled to a refund from Roam Sailing, it will be issued through the same method of payment used for the original online payment. Please note that Roam Sailing is not liable for any fees charged by your bank to accept the refund. The amount refunded may vary due to currency conversions performed by the bank on the day of the transaction, and Roam Sailing cannot be held responsible for any gains or losses resulting from this conversion.
7. No compensation will be payable if we are forced to cancel or make changes to your booking due to war or threat of war, riots, civil unrest, industrial disputes, natural or unnatural disasters, terrorist activities, technical or transportation problems, airport or sea port closures, or alterations or cancellations of scheduled services.
8. Roam Sailing will not reimburse customers who choose to change or not utilize any part of the package arrangements they have booked and paid for.
7. What's not included in the tour price
1. The tour price does not include airfares, insurance, airport taxes, passport and visa fees, medical fees, beverages (unless specified), personal expenses, sightseeing or visits not mentioned in the inclusions list.
2. Croatian Tourist Tax is not included. A fee of €60 EUR per person will be paid upon arrival.
3. Any additional activities, excursions, or optional tours not specifically stated as included in the tour itinerary are not covered by the tour price.
4. Meals and beverages not mentioned as included in the tour itinerary are the responsibility of the traveller and are not included in the tour price.
5. Any costs or expenses incurred as a result of personal choices, preferences, or deviations from the tour itinerary, including but not limited to shopping, additional transportation, or activities outside of the scheduled program, are not covered by the tour price.
6. Travel insurance coverage for medical expenses, trip cancellation, and other unforeseen events is not included in the tour price. It is strongly recommended that travellers obtain appropriate travel insurance to protect themselves against any potential risks or losses.
8. Weather Conditions
1. The safety and well-being of our passengers and crew are of utmost importance to Roam Sailing. Therefore, our Captain has the final authority to make any necessary changes to the itinerary in the event of adverse or unforeseen weather conditions.
2. Please understand that weather conditions, including but not limited to storms, strong winds, or other Acts of God, are beyond the control of Roam Sailing. As such, Roam Sailing cannot be held responsible for any weather-related disruptions, delays, or cancellations.
3. It is important to note that you cannot cancel or amend your tour booking solely based on weather conditions. Our itineraries are carefully planned, and we strive to provide an enjoyable experience even in the event of weather-related challenges. Our Captain will make necessary adjustments to ensure the safety and comfort of all passengers.
4. While we aim to provide the best possible experience, please understand that weather conditions can be unpredictable and may necessitate itinerary changes or alterations. Roam Sailing reserves the right to modify the itinerary, including but not limited to changing ports of call, substituting destinations, or altering the duration of activities, as deemed necessary for the safety and well-being of all passengers.
5. We recommend that you come prepared for various weather conditions by packing appropriate clothing and accessories. It is also advisable to obtain travel insurance that covers any potential weather-related disruptions or losses.
6. By booking a tour with Roam Sailing, you acknowledge and accept that weather conditions are outside our control and that you will not hold Roam Sailing liable for any inconvenience, losses, or damages arising from such conditions.
9. Insurance
1. It is a requirement for all passengers to have personal comprehensive insurance in order to check-in for any Roam Sailing tour.
2. We strongly advise you to obtain insurance coverage that is comprehensive and includes protection for cancellation, tour disruption, death, adventure activities, and medical expenses.
3. Roam Sailing cannot be held liable for any claims made by third parties against any other activity operator you choose to participate in while on a Roam Sailing tour. We are not responsible for any injuries or compensation related to such activities.
4. Comprehensive Travel insurance is compulsory for all Roam Sailing tours.
5. You must have comprehensive travel insurance that provides coverage for personal injury, cancellation, medical expenses, death, and any other items not covered by our tour inclusions. By booking a tour with us, you agree to indemnify Roam Sailing against all claims, damages, actions, and remedies that may be brought against us in connection with your participation in our tours.
6. Roam Sailing cannot be held responsible if you fail to obtain the appropriate insurance coverage. It is your responsibility to ensure that your insurance policy adequately covers your needs and the activities you will be participating in. Some policies may exclude certain adventure activities, so please review your policy carefully.
7. If an insurance letter from Roam Sailing is requested, it will be considered as your confirmation that you will forfeit any payments made to Roam Sailing Pty Ltd and that you will be removed from the tour you have booked.
8. As a minimum requirement, you agree to have adequate insurance coverage that includes cancellation, personal liability, and loss of personal property. Please ensure that your insurance policy covers all the activities you will be participating in during the tour.
10. Ship Rules
1. All passengers on board are required to strictly always adhere to the ship rules. The captain holds full responsibility for the safety of all passengers and crew. The captain has the authority to make necessary changes to the itinerary in the event of adverse weather conditions or other circumstances. The captain's decisions are final and binding.
2. Upon check-in, the captain will collect all passports for registration purposes. Passports will be returned to each passenger upon check-out.
3. Jumping or diving from the boat is only permitted when the boat has safely anchored, engines have been turned off, and the captain has given clearance to do so.
4. Roam Sailing assumes no liability for any injuries that may occur from jumping off the boat. Passengers engage in such activities at their own risk.
5. Jumping or diving from the boat while it is not anchored, or the engine is still running is strictly prohibited. Any passenger found in violation of this rule may be removed from the tour.
6. In the event of rough weather conditions, passengers are advised to minimize movement around the boat, as water can make surfaces slippery. When crossing between boats, passengers should exercise extra caution and seek assistance if needed.
7. Passengers are encouraged to utilize handrails when moving around the boat, regardless of weather conditions.
8. Outside alcoholic and non-alcoholic drinks are not permitted to be brought on board the boat.
9. Any passenger who fails to comply with or refuses to adhere to any of the Roam Sailing terms and conditions may be subject to removal from the tour. Roam Sailing cannot be held responsible for any costs associated with the removal from the boat or tour.
10. Roam Sailing's tours do not include any pre or post-travel arrangements or costs associated with pre or post-accommodation or travel.
11. Passengers are responsible for any costs incurred for damage caused to their cabin or the boat. In the event of any accidents, it is mandatory to report them immediately to the Roam Sailing representative or the captain of the boat.
12. Guests must comply with all rules and regulations of the boat at all times. No exceptions will be made.
13. Passengers are responsible for the safety and security of their personal belongings while traveling. Roam Sailing will not be held liable for any loss or damage to personal belongings during the tour or if left behind.
14. It is strictly forbidden to remove any bed linen from the cabins.
15. In case of loss of the cabin key, a fee of €50 EUR per key will be charged.
16. Upon checking onto your tour, you consent to Roam Sailing representatives taking photographs and videos of you during the tour for use in advertising or promotional materials without further consent or compensation.
17. Guests are required to comply with all ship rules, rules can be found in written form on board. It is mandatory to adhere to these rules.
18. In the event of any inappropriate behaviour, Roam Sailing and the captain retain the right to remove any passengers from the tour.
19. Roam Sailing holds no liability for accidents that may occur on-board and emphasizes the importance of guests being aware of this and exercising extra caution while on-board or when moving between ships.
20. Certain ports have specific mooring conditions and requirements. As a result, guests may need to cross between ships, taking into account the gaps between them, in order to reach the shore. It is crucial for guests to exercise special care during these crossings, understanding that they assume the risk themselves. Crew members are available to assist guests upon request.
11.Illness or Absenteeism
1. In the event that you are unable to join the tour within 29 days of departure or need to leave the tour mid-way due to sickness or illness, no refund will be provided. However, Roam Sailing will provide you with an insurance letter as evidence for you to make a claim for any financial losses through your insurance company.
12. Complaints
1. If you have any complaints regarding the tour, it is important to communicate them to your onboard Roam Sailing Representative during the tour. If the matter cannot be resolved to your satisfaction, please submit your complaint via email to Roam Sailing at info@roamsailing.com no later than fifteen (15) days after the completion of your tour.
2. We strive to address all complaints promptly and thoroughly. We will acknowledge receipt of your complaint within three (3) business days and aim to provide a resolution within thirty (30) days of receiving the complaint in writing.
3. Please note that complaints received outside of the specified time frame or those not submitted in writing may not be considered or taken into account.
