Terms & Conditions

1. Booking Confirmation and Contract Formation
1.1 A binding travel contract is formed only when Roam Sailing Pty Ltd issues written confirmation acknowledging acceptance of your booking. No verbal quotation, provisional hold, or payment alone shall create any entitlement to a confirmed place.
1.2 Roam Sailing reserves the right to decline a booking at its discretion until confirmation has been formally issued.
1.3 All reservations remain subject to vessel availability and operational approval. Where a booking cannot be confirmed, any funds received will be returned in full without further liability.
1.4 By accepting Roam Sailing’s written confirmation, the traveller agrees that these Terms and Conditions govern the entire contractual relationship between the parties.

2. Deposits, Payments and Booking Obligations

2.1 To secure a position on any Roam Sailing tour, a non-refundable deposit of €250 per person is required, unless otherwise confirmed in writing by Roam Sailing Pty Ltd. Payment of this deposit constitutes acceptance of all terms contained herein.

2.2. Successful payment of your non-refundable deposit or full fare signifies your full understanding and agreement to Roam Sailing’s Terms and Conditions. Guests are advised to obtain independent travel insurance as deposits and payments are non-recoverable.

2.3 A booking will only be recognised as confirmed once Roam Sailing has issued written confirmation acknowledging receipt of the required funds. Deposits form part of the overall fare and remain strictly non-refundable.

2.4 Upon receiving confirmation of your booking enquiry from Roam Sailing, you will have seven (7) days to secure your reservation by paying the non-refundable deposit of €250 per person. Failure to pay within this timeframe authorises Roam Sailing to cancel the provisional booking without notice.

2.5 Below is the required payment timetable, which forms a condition of your contract:

  • Bookings made 90 days or more before departure:
    Deposit must be received within 7 days of booking. Final balance is due 90 days prior to departure.

  • Bookings made within 90 days before departure:
    Deposit must be received within 7 days of booking. Final payment is due within 7 days after the deposit is received.

  • Bookings made within 60 days before departure:
    Deposit must be received within 3 days of booking. Final payment is due within 3 days after the deposit is received.

Failure to meet any payment deadline permits Roam Sailing to cancel the booking immediately and retain all monies paid as liquidated damages for administrative and opportunity loss.

2.6 All booking confirmations, invoices, and receipts are issued by email. Guests must ensure that correspondence from Roam Sailing is received and not diverted to spam or junk folders. The Company accepts no responsibility for non-delivery due to user-side filtering or address errors.

2.7 For bookings made using promotional codes, vouchers, or discounts, payment is required at the time of booking unless expressly agreed otherwise in writing by Roam Sailing. Discounts cannot be added retrospectively to existing bookings.

2.8 Guests must disclose in writing any physical, medical, dietary, or other special requirements at the time of booking. Failure to disclose relevant information authorises Roam Sailing to deny boarding or cancel the booking without refund or compensation.

2.9 The person completing the booking represents and warrants that they have full authority to act on behalf of all named travellers and to bind them jointly to Roam Sailing’s Terms and Conditions. The Lead Traveller is responsible for ensuring all payments are completed by the stated deadlines.

2.10 Bookings made prior to 3 April 2020 were granted specific payment extensions. Any invoice issued before 21 May 2020 is void and superseded by the updated post-COVID schedule communicated to all affected guests.

2.11 Bookings using travel credit must be confirmed no later than 1 April 2024 for tours scheduled in 2023 or 2024. Failure to confirm by this date will result in the forfeiture of all unused credit. Availability is subject to written confirmation by Roam Sailing.

2.12 Discount codes cannot be retrospectively applied to any booking made using travel credit unless the same code was applied at the time of the original booking.

2.13 Failure to pay the deposit within the required timeframe may result in automatic cancellation without prior notice or refund.

2.14 All deposits are strictly non-refundable and non-transferable. This condition applies under every circumstance, including illness, change of mind, or inability to travel.

2.15 All reservations remain subject to vessel availability. A guest’s participation is only secured once full payment has been received and acknowledged in writing by Roam Sailing.

2.16 Where approved, guests may elect a Split Payment Option allowing the total fare (less deposit) to be divided into three equal instalments. A one-time administration fee of €10 will be charged on the first invoice. The final instalment must be paid by the due date shown on the final invoice; failure to do so constitutes cancellation by the guest and results in forfeiture of all monies paid.

3. Participation Requirements and Operational Conditions

3.1 It is the responsibility of each guest to thoroughly review the tour information, inclusions, and exclusions prior to booking. No refunds, price reductions, or compensation of any kind will be provided for items, services, or activities not expressly listed as included in your itinerary or promotional materials.

3.2 If any traveller behaves in a manner that poses a risk to their own safety, the safety of others, or disrupts the enjoyment or operation of the tour, Roam Sailing reserves the absolute right, at its sole discretion, to remove that person from the vessel or activity without refund or compensation. All associated costs of removal or repatriation will be borne solely by the individual concerned.

3.3 Roam Sailing does not provide personal care services or mobility equipment of any nature. This includes but is not limited to wheelchairs, hearing aids, or prescription eyewear, as well as personal assistance such as mobility support, toileting, feeding, or dressing. Any guest requiring such assistance must travel with a competent companion who can provide the required support independently.

3.4 Roam Sailing does not employ medical professionals and is not responsible for providing medical services or advice. Should a guest require medical care during the tour, all related expenses, transportation, and loss of participation days will be the sole responsibility of the traveller. Guests are strongly advised to hold comprehensive travel insurance covering medical emergencies, evacuation, and cancellation.

3.5 Roam Sailing reserves the right to substitute, replace, or modify the vessel or equipment advertised if operational needs, maintenance, safety considerations, or unforeseen circumstances require such action. Vessel substitutions may include alternative boats of similar standard and configuration.

3.6 Roam Sailing and/or the Captain may at any time amend, adjust, or substitute elements of the published itinerary due to safety concerns, weather conditions, port restrictions, operational demands, or other events beyond the Company’s control. Such modifications do not constitute grounds for cancellation, refund, or compensation. The Captain’s decisions regarding navigation and safety are final.

3.7 In the event that any legal claim or proceeding against Roam Sailing Pty Ltd is unsuccessful, the guest agrees to indemnify and reimburse Roam Sailing for all legal expenses, including but not limited to solicitor–client costs, expert fees, and disbursements incurred in defending such action.

3.8 While every effort is made to ensure that all website, brochure, and advertising materials are accurate at the time of publication, Roam Sailing does not accept responsibility for typographical errors, misprints, or information that may change due to operational or external circumstances beyond its control.

3.9 These Terms and Conditions apply to all bookings made through any communication channel — including but not limited to Roam Sailing’s official website, social media platforms, direct correspondence, and authorised third-party booking agents.

3.10 By confirming a booking, each traveller acknowledges that they have read, understood, and accepted these Terms and Conditions in full. All references to “Roam Sailing,” “the Company,” “we,” or “our” refer to Roam Sailing Pty Ltd

4. Guest-Initiated Cancellations and Refund Terms

4.1 Should you elect to cancel your booking, Roam Sailing Pty Ltd (“Roam Sailing”) will have already incurred administrative and operational expenses connected to your reservation. You therefore accept that cancellation charges will apply in accordance with this policy and constitute a genuine pre-estimate of Roam Sailing’s loss.

4.2 If you cancel your booking outside the 100-day notice period, your deposit remains strictly non-refundable and non-transferable.

4.3 Cancellation fees are calculated as a percentage of the total tour price, per person, according to the schedule below:

  • More than 100 days’ notice: Only the deposit is forfeited.

  • 99 – 90 days’ notice: 25 % of the tour price is forfeited.

  • 89 – 60 days’ notice: 50 % of the tour price is forfeited.

  • 59 – 30 days’ notice: 75 % of the tour price is forfeited.

  • 29 days or fewer: 100 % of the tour price is forfeited.

For the avoidance of doubt, the “notice period” begins on the calendar date that Roam Sailing receives your written cancellation under clause 4.8. These percentages are automatically enforceable and not subject to negotiation.

4.4 Where a partial refund is due, it will be processed only by the same payment method originally used. Roam Sailing will not issue refunds to alternate accounts, new cards, or third parties under any circumstances. All refunds are issued in Euro (€); exchange-rate variations are borne by the traveller.

4.5 All refund transactions are handled via Roam Sailing’s authorised online payment gateway. Any processing, merchant, or receiving-bank fees charged by third-party providers lie outside Roam Sailing’s control and remain entirely the responsibility of the traveller.

4.6 Refund values may differ from original amounts paid due to daily changes in foreign-exchange rates or bank conversion margins. Roam Sailing accepts no liability for gains or losses caused by such fluctuations.

4.7 Approved refunds are typically processed within 30 working days from the date written eligibility is confirmed. Delays arising from banking institutions, payment networks, or currency-exchange intermediaries do not constitute breach by Roam Sailing.

4.8 All cancellations must be communicated in writing via email to info@roamsailing.com. Cancellations are effective only once acknowledged by Roam Sailing in writing. The date of receipt of the guest’s written notice determines the applicable fee under clause 4.3.

4.9 Payments made through the online system incur a 3.95 % transaction fee, levied directly by the payment processor (Pin Payments). This fee is non-refundable, irrespective of any later cancellation, amendment, or refund request.

5. Booking Amendments and Date Changes

5.1 If, after confirmation of your booking, you wish to make alterations and more than 59 days remain before departure, you may request to transfer your reservation to an alternative Roam Sailing departure date. Approval is strictly subject to availability and must be confirmed in writing by Roam Sailing.

5.2 A non-refundable €30 EUR administration fee applies to each confirmed change or amendment, including but not limited to name changes and departure-date adjustments. This fee covers internal administrative and documentation costs incurred in processing such changes.

5.3 Where a revised departure date or tour option carries a higher advertised price, the fare difference becomes immediately payable with your final invoice. If the original final invoice has already been paid, you are granted a five-day grace period from the date of written confirmation to settle any outstanding balance. Failure to pay within that timeframe constitutes a voluntary cancellation under clause 4.

5.4 If you are unable to travel due to illness, injury, or any certified medical condition that renders you unfit to participate in the tour, Roam Sailing may, at its sole discretion, allow you to transfer your booking to another available Roam Sailing tour, subject to availability.
To qualify, you must provide a doctor’s certificate written in English verifying your inability to travel.

Where availability allows, the transfer will be processed in accordance with current pricing.
Any increase in fare, currency difference, or additional costs (including administrative or rebooking fees) are the sole responsibility of the traveller.
If no suitable alternative tour is available, you must make any claim for reimbursement or coverage through your own travel insurance provider.

5.5 All requests made under clause 5.4 must include the relevant medical certificate and be submitted in writing to info@roamsailing.com prior to the scheduled departure. Failure to supply sufficient medical evidence will void eligibility for any transfer or consideration under this clause.

6. Roam Sailing Cancellations and Operational Changes

6.1 Roam Sailing Pty Ltd (“Roam Sailing”) reserves the unconditional right to cancel, postpone, or modify any booking, itinerary, or vessel assignment at any time due to operational requirements, safety considerations, low passenger numbers, or other unforeseen circumstances beyond its reasonable control.

6.2 In the event Roam Sailing must alter or cancel a confirmed booking, reasonable written notice will be provided as soon as practicable, taking into account the nature of the event. Where possible, a comparable alternative sailing or departure will be offered at Roam Sailing’s discretion.

6.3 If the cancellation or change arises from an event outside Roam Sailing’s control — including but not limited to political unrest, industrial action, port or airport closures, war or threat thereof, riots, civil disturbance, terrorism, fire, natural or nuclear disaster, public health risk, epidemic, pandemic, extreme weather, or other Acts of God — no refund will be issued. Instead, Roam Sailing will provide a travel credit for the value of services not yet rendered, redeemable against a future Roam Sailing tour. All other costs, including transport, accommodation, or losses caused by such events, remain the responsibility of the traveller and should be claimed through personal travel insurance.

6.4 If a suitable alternative tour cannot be provided, or if the traveller declines the alternative offered, a credit note valid for 12 months from the original tour date will be issued. Travel credits are non-transferable, hold no cash value, and may only be redeemed toward Roam Sailing products.

6.5 Roam Sailing reserves the right to cancel any departure that does not meet its minimum passenger requirement (for example, fewer than 15 passengers on a Croatia Sail departure). Where practicable, reasonable notice will be given. Roam Sailing shall not be held responsible for any ancillary travel, accommodation, or other arrangements affected by such cancellation or schedule change.

6.6 Where a refund is expressly approved by Roam Sailing, it will be issued only through the same payment method used for the original transaction. All refunds are processed in Euro (€). Any bank, merchant, or exchange fees incurred in receiving funds are borne by the traveller. Roam Sailing accepts no liability for exchange-rate fluctuations or differences between the amount paid and the amount refunded.

6.7 No financial compensation, consequential damages, or liability of any kind will be payable where a cancellation or change results from circumstances outlined in clause 6.3, including but not limited to war, civil unrest, industrial disputes, technical failures, transport disruption, or weather-related events.

6.8 No reimbursement or credit will be provided to any guest who voluntarily elects to alter, shorten, or not utilise any portion of the travel package once the tour has commenced.

 

7. Exclusions and Additional Expenses

7.1 The advertised tour fare covers only the services and inclusions expressly stated by Roam Sailing Pty Ltd (“Roam Sailing”). The following are not included and remain entirely the responsibility of the traveller:
airfares to and from the point of embarkation or disembarkation, travel insurance premiums, airport or port taxes, passport and visa fees, medical consultations or treatment, beverages (unless specifically stated as included), personal spending, and any sightseeing, admission, or visit not explicitly mentioned in the published inclusions list.

7.2 The mandatory Croatian Tourist Tax is excluded from the tour price. A separate fee of €60 EUR per person is payable upon arrival. This tax is collected in accordance with local regulations and may be subject to change without prior notice.

7.3 Any optional excursions, third-party activities, or external services not expressly listed as part of the confirmed itinerary are undertaken solely at the traveller’s discretion and expense. Roam Sailing accepts no liability for such activities, whether organised independently or through outside operators.

7.4 Meals, snacks, and beverages not detailed as part of the inclusive program are not covered by the tour price. The cost of any additional food or drinks purchased on board or ashore is the sole responsibility of the traveller.

7.5 Costs arising from personal choices or itinerary deviations—including, without limitation, shopping, private transportation, extended stays, early departures, or any self-arranged diversions from the scheduled program—are not included and remain entirely at the traveller’s expense.

7.6 Comprehensive travel insurance is not included in the tour price. Travellers are strongly advised to obtain a policy covering medical expenses, cancellation, curtailment, theft, loss of property, and other unforeseen circumstances prior to departure. Roam Sailing bears no responsibility for any losses, costs, or damages that may occur as a result of a traveller’s failure to obtain adequate insurance protection.

 

8. Adverse Weather and Itinerary Adjustments

8.1 The safety, comfort, and well-being of all guests and crew remain Roam Sailing Pty Ltd’s (“Roam Sailing”) highest priority. Accordingly, the Captain retains full and final authority to modify, delay, or cancel any portion of the itinerary whenever adverse or unforeseen weather conditions are deemed to pose a risk to safety or navigation.

8.2 Weather conditions—including but not limited to storms, high winds, heavy rain, or other Acts of God—are entirely outside Roam Sailing’s control. The Company accepts no responsibility or liability for any delays, itinerary alterations, or cancellations resulting from such events.

8.3 Guests acknowledge that bookings cannot be cancelled, amended, or refunded solely due to weather conditions. All itineraries are designed with flexibility to accommodate necessary adjustments while maintaining an enjoyable and safe travel experience. Roam Sailing and the Captain will determine all appropriate changes in their absolute discretion.

8.4 In circumstances where weather or safety requires a deviation, Roam Sailing reserves the right, at any time and without prior notice, to modify ports of call, substitute destinations, adjust sailing routes, or amend the duration of scheduled activities. Such changes shall not constitute grounds for refund, credit, or compensation.

8.5 Guests are encouraged to prepare for a range of possible weather conditions by packing suitable clothing and personal accessories. It is strongly recommended that travellers maintain comprehensive travel insurance which includes coverage for any potential delays, disruptions, or additional costs caused by adverse weather.

8.6 By proceeding with a booking, guests acknowledge and accept that weather conditions fall outside the control of Roam Sailing. The traveller agrees not to hold Roam Sailing, its officers, staff, or contractors liable for any inconvenience, alteration, or financial loss arising directly or indirectly from weather-related circumstances.

 

9. Travel Insurance Requirements and Coverage

9.1 It is a strict condition of travel that all guests hold valid, comprehensive travel insurance prior to check-in for any Roam Sailing Pty Ltd (“Roam Sailing”) tour. Proof of insurance may be requested at any time before embarkation.

9.2 Travellers are strongly encouraged to obtain insurance providing comprehensive protection, including but not limited to coverage for trip cancellation or interruption, medical treatment and evacuation, personal accident or death, adventure and recreational activities, loss of baggage or personal effects, and delays arising from force majeure events.

9.3 Roam Sailing bears no responsibility or liability for any claim, injury, loss, or damage arising from the traveller’s participation in independent or third-party activities not operated directly by Roam Sailing. Any arrangements made with outside providers are undertaken entirely at the traveller’s own risk.

9.4 Comprehensive travel insurance is compulsory for participation in all Roam Sailing tours. Guests who fail to present evidence of appropriate insurance may be denied boarding without refund or compensation.

9.5 You must hold a policy that covers, at a minimum, personal injury, medical expenses, cancellation, loss or theft of property, and accidental death. By confirming a booking, you agree to fully indemnify and hold harmless Roam Sailing, its officers, employees, and contractors from any and all claims, damages, or legal actions arising from your participation in the tour, whether directly or indirectly related to insufficient or absent insurance coverage.

9.6 It is solely the traveller’s responsibility to ensure that their insurance policy is suitable for the type of tour and the activities undertaken. Roam Sailing accepts no liability for losses where the policy purchased does not provide adequate protection. Travellers should verify that their policy does not exclude water-based or adventure activities commonly featured on our tours.

9.7 If Roam Sailing issues a written confirmation or supporting document for insurance purposes, this will be treated as acknowledgment that the traveller intends to withdraw from the tour and will forfeit any payments previously made. In such cases, Roam Sailing reserves the right to release the cancelled berth to another guest.

 

10. Vessel Conduct and Safety Regulations

10.1 The Captain has full command of the vessel and absolute authority regarding safety, navigation, itinerary, and passenger conduct. All persons on board must comply with the Captain’s instructions at all times. Decisions made by the Captain are final and binding.

10.2 Passengers must always comply with Roam Sailing Pty Ltd (“Roam Sailing”) rules, safety instructions, and crew directions. Failure to do so may result in immediate removal from the tour without refund or compensation. All resulting expenses remain the responsibility of the passenger.

10.3 Safety equipment—life jackets, extinguishers, alarms, and emergency exits—must remain in place and used only in emergencies. Guests must familiarise themselves with muster points and follow all crew instructions during drills or emergencies.

10.4 Passports are collected upon embarkation for port registration and kept securely by the Captain until disembarkation. Passengers are responsible for their own valuables; Roam Sailing accepts no liability for loss or damage to personal items.

10.5 Passengers must be physically capable of safely participating in the voyage. Any conduct that endangers others, breaches law, or disrupts the enjoyment or safety of the tour may result in removal from the vessel without refund. Any related travel or accommodation costs remain the passenger’s responsibility.

10.6 Guests must use handrails when moving about the vessel, particularly in rough weather or wet conditions. During adverse seas, movement should be limited, and extra caution exercised. Crew assistance is available on request.

10.7 At some ports, multiple ships may berth side-by-side. Guests crossing between vessels do so entirely at their own risk and must use caution when gaps exist. Crew can assist upon request.

10.8 Any accident, injury, or damage must be reported immediately to the Captain or a Roam Sailing representative. Roam Sailing bears no responsibility for accidents occurring on or around the vessel. Participation is at each guest’s own risk.

10.9 Entering the water is allowed only when the vessel is fully anchored, engines are off, and the Captain has granted permission. All water activities are undertaken at the passenger’s own risk.

10.10 Jumping or diving while the vessel is manoeuvring, under power, or not anchored is strictly prohibited. Breach of this rule may result in removal from the tour without refund.

10.11 Only beverages purchased on board may be consumed unless written approval is given by Roam Sailing. The possession or use of illegal drugs or controlled substances will result in immediate removal from the tour and may be reported to authorities.

10.12 Out of respect for fellow travellers and local communities, quiet hours will be enforced unless otherwise advised. Guests must observe any additional restrictions imposed by ports, marinas, or national parks.

10.13 Smoking, vaping, and open flames are permitted only in designated outdoor areas. They are strictly prohibited inside cabins or enclosed spaces. Cigarette waste must be fully extinguished and disposed of safely—never overboard.

10.14 All bedding, towels, and furnishings must remain in the cabin. Removal or misuse of these items is not permitted.

10.15 Lost cabin keys incur a replacement fee of €50 EUR per key. Passengers are financially responsible for any damage or loss they cause to the vessel, its equipment, or their cabin.

10.16 Roam Sailing’s tour packages exclude flights, accommodation, or transport before or after the voyage unless expressly stated in writing. All associated costs are the passenger’s responsibility.

10.17 Passengers are solely responsible for safeguarding their personal property. Roam Sailing is not liable for theft, loss, or damage to belongings left on board or ashore.

10.18 By joining a Roam Sailing tour, passengers grant Roam Sailing the right to photograph and film them during the voyage for promotional and advertising use without further approval or compensation.

10.19 Ship-specific policies and safety notices displayed on board form part of these terms and conditions. Passengers are deemed to have read and accepted them.

10. 20 By booking with Roam Sailing, passengers acknowledge that maritime travel carries inherent risks. They agree to exercise due care and hold Roam Sailing harmless from any injury, loss, or damage arising from participation in the tour.

 

 

11. Medical Incapacity and Tour Withdrawal

11.1 If a guest is unable to participate in the tour due to illness, injury, or any medical condition within 29 days of the scheduled departure date, no refund or credit will be issued by Roam Sailing Pty Ltd (“Roam Sailing”).

11.2 Should a passenger need to withdraw or disembark partway through a tour for any reason, including illness, injury, or personal emergency, no portion of the tour cost is refundable or transferable. All additional expenses incurred, including medical treatment, accommodation, or onward travel, are the sole responsibility of the passenger.

11.3 Roam Sailing may, at its discretion, assist the affected passenger in obtaining medical attention or local healthcare services. Any such assistance is provided as a courtesy only and does not create liability or responsibility for outcomes, expenses, or delays.

11.4 Roam Sailing will, upon request, issue a written insurance letter confirming the unused portion of your booking to support a potential travel insurance claim. This documentation does not imply financial responsibility or guarantee any reimbursement by Roam Sailing.

11.5 Guests are strongly advised to ensure their travel insurance covers cancellation, medical evacuation, and any additional costs resulting from illness or absenteeism before, during, or after the tour.

12.5 Guests are strongly advised to purchase travel insurance prior to making a booking on a Roam Sailing tour.

 

12. Feedback, Disputes and Complaints Procedure

12.1 Roam Sailing Pty Ltd (“Roam Sailing”) is committed to maintaining the highest standard of service. Should any issue arise during your tour, you must raise it immediately with your onboard Roam Sailing Representative or Captain to allow reasonable opportunity for rectification at the time of occurrence.

12.2 If the matter cannot be resolved onboard to your satisfaction, a formal written complaint must be submitted by email to info@roamsailing.com within five (5) days of the tour’s completion. Complaints lodged after this period, or not made in writing, may be disregarded at Roam Sailing’s discretion.

12.3 Upon receipt of a valid written complaint, Roam Sailing will acknowledge the correspondence within five (5) business days and will make reasonable efforts to investigate and issue a written response or resolution within thirty (30) days.

12.4 Roam Sailing’s decision following internal review is final and binding. No refund, credit, or compensation will be considered for claims made after the above timeframes or without documented proof that the issue was first raised during the tour.

12.5 While every effort is made to ensure the accuracy of Roam Sailing’s website and marketing materials, typographical or clerical errors, or changes arising from operational or external circumstances, shall not constitute grounds for complaint or compensation.

13. Competition Terms & Conditions

13.1 Prize: One (1) winner will receive a spot on a Roam Sailing tour. The prize includes the same experience, inclusions, and conditions as any paying guest.

13.2 Exclusions: Flights, travel insurance, and any personal expenses are not included and are the responsibility of the winner.

13.3 Eligibility: Entrants must be 18 years or older at the time of entry.

14.3 Non-Transferable: The prize is non-transferable, non-refundable, and cannot be exchanged for cash or any other service.

13.5 Travel Dates: The tour must be taken on dates specified by Roam Sailing. No alternatives will be offered.

13.6 Acceptance: By entering, the winner agrees to Roam Sailing's standard booking terms and waivers, including safety and liability clauses.
